DICTIONARY
"we", "us" means sfm uk enterprise Ltd
1. ELIGIBILITY
1.1. Eligibility to apply. You can only file the application to smartCLUB in case you are aged over 18 and have legal capacity to enter in the contract with us. You must have a right to reside in Sweden (in the case you are non EEA citizens, you may apply if you have permission to live in Sweden permanently)
1.2. Breaches. By filing the application, you confirm you are not in breach of any agreements with sfm uk enterprise ltd, smart foods market ltd, and in breach with Law of Sweden, Law of England and Wales, Law of Scotland and Law of Germany.
1.3. Identity. You have to check that all of the information that you enter are correct before submitting the application. In the case, you would create false identity to pretend to be someone else, your application will be immediately suspended and you will not be able to reapply in the future, also you might be reported to authorities.
1.4 Other conditions. Whole registration process shall be in English language.
2. TERMINATION.
2.1 Right to suspend. In the case you would provide us with false information or you pretend to be someone else, we reserve the right to terminate your membership immediately. In the case you would commit crime, we reserve the right to suspend your membership temporarily or terminate the membership immediately. In the case your behaviour in the public/online space would harm other people or animals, we reserve the right to suspend your membership temporarily or terminate your membership immediately.
2.2. Ability to withdraw application. You have right to withdraw the application up to 15 calendar days after you officially became the OwnersClub member, shall you do so, you must do it by writing to us at smartclub@smartfoodsmarket.com We reserve a right to process your withdrawal within 30 calendar days, and you will be entitled to full refund you have paid during the registration process.
2.3 Death.
In the case of death, the membership would be terminated from the day, we'd receive the copy of death certificate by surviving relatives or relevant authorities.
3. PROCESS
3.1. Application. To join the smartCLUB you have to submit the application (see www.smartfoodsmarket.com/se/smartclub). and make sure all information filled in are correct, otherwise your membership might be suspended (see 1.1.)
3.2.Payment. Memberships enters into validity from the day the membership fee is received via bank transfer. The bank account details will be provided to you on the invoice sent to you via email.
3.3. Bank account details. Account holder details must match details filled in the application. Shall be different we reserve right not to accept such payment; the payment will be refunded to the account and your application will be suspended.
3.4. Refund-ability.The membership fee is fully refundable. You are entitled to withdraw application up to 15 calendar days after your membership started, shall you do so, you will be refunded the payment in full within 30 calendar days. In the following cases (see 2.1.), you might lose your right to refund (see 2.4) In the case of death, illness, war, natural disaster or sudden loss of a family member, you are entitled to full refund, however you will have to provide us with relevant official documents confirming your status e.g. document signed and stamped by doctor (in the case of illness).
4. CHANGES
4.1 Right to update. We reserve the right to change, update terms and conditions, shall we do so, we will inform you at least 30 calendar days before the new terms and conditions would enter into validity. In such case, you have right to terminate your membership, shall you do so, you will be sent information.
These terms and conditions are governed by English law. This means that your membership, and any dispute or claim arising out of or in connection therewith (including non-contractual disputes or claims) will be governed by English law and you agree to the jurisdiction of the Courts of England and Wales in relation to any such dispute or claim. If you live in Scotland you can bring legal proceedings in either the Scottish or the English courts.
